1. Introduction
These Terms and Conditions (“Terms”) govern the use of the recruitment platform hiring.ecomyogi.in (“Platform”) operated by EcomYogi G Works OPC Private Limited, having its registered office at 703, Liverpool, Panvelkar Green CHS, Ambarnath (E), Thane – 421501, Maharashtra, India (“Company”, “we”, “us”)
By accessing or using the Platform, you (“Employer”, “you”) agree to these Terms, our Privacy Policy, and Refund & Cancellation Policy (together, “Policies”).
By creating a candidate account or applying for any job through the Platform, Candidates agree to be bound by these Terms, as applicable to Candidates, and by the Privacy Policy.
For the purpose of further clarity, this document is an electronic record in terms of the Information Technology Act, 2000, (“IT Act“), amendments thereof from time to time and the rules thereunder as applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the IT Act. This electronic record is generated by a computer system and does not require any physical or digital signatures.
1.1 Definitions
For the purposes of these Terms, unless the context otherwise requires:
(a) “Employer” means any individual, sole proprietor, partnership, company, limited liability partnership, trust, society, or other legal entity that accesses or uses the Platform to post job opportunities or engage candidates.
(b) “Candidate” means any individual who registers on the Platform for the purpose of seeking employment, including persons with disabilities.
(c) “User” means any Employer or any other person accessing or using the Platform.
(d) “Platform” means the recruitment facilitation job portal or website and app
(e) “Website” shall mean the website owned and operated by Ecomyogi G works available at hiring.ecomyogi.in
“Services” means recruitment facilitation, job posting, candidate discovery, communication, and related support services provided by the Company through the Platform.
2. Nature of Services
The Platform is a recruitment facilitation service that connects Employers with local talent, who are People with Disabilities (PwD), generally within a radius of approximately 10 km from the job location, for full‑time, part‑time and work‑from‑home roles.
The Company:
acts only as an intermediary and not as an employer, staffing agency, or principal;
does not guarantee job placement, employment, hiring, offer acceptance, performance, or retention of any Candidate;
does not charge any placement fee to candidates.
- You hereby agree and acknowledge that you have provided the necessary consent on the Platform and in relation to the Services, after having carefully gone through the Terms and Privacy Policy. Further, you agree and acknowledge that once you express interest and/or apply to a job, you will be subjected to the selection and interview process that is adopted and implemented by the job poster, at its sole discretion. Such selection and interview process may involve the use of artificial intelligence (AI) based models for conducting preliminary interviews. Hiring.ecomyogi.in shall not be responsible and/or liable for the selection and interview process being adopted by the job poster.
- The Platform may use automated tools, algorithms, artificial intelligence systems, or third-party AI-enabled services for functions including but not limited to candidate matching, job recommendations, screening assistance, communication facilitation, accessibility support, and platform optimization.
- The Company does not guarantee the accuracy, completeness, fairness, suitability, or outcomes of any AI-generated suggestions, rankings, communications, or automated processes. Such tools are provided on a best-effort basis and are intended to assist, not replace, human judgment.
- The Company shall not be liable for any errors, omissions, bias, technical failures, or adverse outcomes arising from the use of AI-based or automated systems, including but not limited to missed opportunities, incorrect matches, accessibility limitations, or employment decisions taken by Employers or Job Seekers.
- You agree and acknowledge that hiring.ecomyogi.in utilises or may utilise third-party AI platforms to provide the Services. You acknowledge that your data may be processed by such third-party platforms. Hiring.ecomyogi.in disclaims all liability for the loss of data, errors, and downtime, governmental policy or enforcement actions related to these platforms.Hiring.ecomyogi.in has no control over these platforms and shall not be held responsible for their performance, availability, or accuracy
- The job applications by the Users on the hiring.ecomyogi.in Platform shall remain active only for a period of 60 (Sixty) days from the date of application to the job posts, and upon the expiry of the said period of 60 (Sixty) days, such job applications shall be archived (“Archived Job Applications“). The potential employers shall not have access to the list of such Users or to the Archived Job Applications upon the expiry of 60 (sixty) days. The Users, however, may reapply to a job post (if still active) after the expiry of 60 (sixty) days from the date such User made their first application to the same job post.
- The Services may include services, content, documents, and information owned by, licensed to, or otherwise made available by a third party or our Affiliates (“Third Party Services“), and may also include links to the Third Party Services. You understand and acknowledge that Third Party Services are the responsibility of the respective third-party or Affiliate that renders such Third Party Services. You further acknowledge that your use of such Third Party Services is solely at your own risk.
- We make no representations and disclaim all warranties and liabilities arising out of or pertaining to such Third Party Services including their accuracy or completeness. Should you avail any Third Party Service, you shall be governed and bound by the Additional Terms and Conditions of the applicable third party or the Affiliate providing the Third Party Service.
- We shall send all communications to our users by text messages, electronic mails, WhatsApp messages, AI driven calls, push notifications and/or via other progressive technology in connection with your access to the Platform, utilisation of the Services and as part of our promotional and marketing strategy. You agree to receive all messages, emails, AI driven calls, and/or WhatsApp messages including transactional messages from us, any third parties and our Affiliates. We may use third party service providers to send alerts or to communicate with you. You authorize us, our Affiliates and other entities providing Third Party Services to override the DND settings to reach out to you over calls, SMS, emails and any other mode of communication. In the event you are aggrieved due to our communications with you, please contact us in the manner we have set out under the Privacy Policy.
2.10 You hereby accept full responsibility for any consequences that may arise from your use of the Services or the Platform, and expressly agree and acknowledge that hiring.ecomyogi.in shall have absolutely no liability with respect to the same.
3. Eligibility and Account
Employers must be legally permitted to hire in India and, where applicable, duly incorporated/registered as per Indian law.
The person creating an Employer account confirms being authorised to bind that entity and is responsible for ensuring that all information shared is true, accurate, current, and complete, and for keeping login credentials confidential. By accepting these Terms, you represent and warrant that
- you have full legal capacity, right and authority to agree to and be bound by these Terms,
- you are at least 18 (eighteen) years of age or older,
- you are an Indian resident,
- you have not been previously suspended or removed by hiring.ecomyogi.in or any of its Affiliates from availing the Services or have been disqualified from availing any Services,
- you are not barred or otherwise legally prohibited from accessing or using the Services and
- you are not and will not impersonate any person, entity or falsely state or otherwise misrepresent such person’s or entity’s identity. A person who is not competent to contract (a minor, a person of unsound mind, etc.) may not access this Platform and use the Services without the consent of his or her guardian. The guardian is presumed to have read these Terms to give consent on behalf of a minor and shall be bound by these Terms. If at any time, hiring.ecomyogi.in is of the opinion that you do not satisfy the eligibility criteria, including but not limited to any misrepresentation, misuse of any Service or offers, fraudulent or suspicious activities or transactions, hiring.ecomyogi.in retains all rights to disable your access to the Platform and/or suspend your use of the Services with immediate effect.
4. Account Verification & Suspension Right
The Company reserves the right to verify the identity, credentials, and authority of any User and may suspend or restrict access to the Platform pending completion of such verification, without prior notice, where deemed necessary for legal, compliance, or security reasons.
5. Employer Obligations
Employers agree to:
- Post only genuine, lawful job openings with accurate details of role, location, work mode, compensation and working conditions.
- Comply with all applicable laws, including labour laws, the Rights of Persons with Disabilities Act, 2016 and Rules, Transgender Persons (Protection of Rights) Act, 2019 (as applicable), and other equality, anti‑discrimination and social security laws.
- Treat all candidates fairly and not discriminate on disability, gender, age, religion, caste, sexual orientation, or any other protected ground, and provide reasonable accommodation to PwD candidates where required and feasible.
- Use candidate data only for lawful recruitment‑related purposes, in line with our Privacy Policy and applicable data protection law, and not sell, rent, or misuse such data.
- Not post illegal, misleading, defamatory, obscene, or harmful content, and not upload malware or attempt to disrupt the Platform.
- Employers confirm compliance with the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, including constitution of an Internal Committee where applicable.
- Employers further agree to maintain a safe, inclusive, and harassment-free workplace for all individuals, including persons of all genders and persons with disabilities, through appropriate internal policies, grievance mechanisms, and codes of conduct, in accordance with applicable law.
- Assessment, provision, and implementation of reasonable accommodation under applicable disability laws shall be the sole responsibility of the Employer. The Company’s role is limited to facilitating communication of accommodation requirements as provided by the candidate.
- While statutory grievance mechanisms may apply to specific categories of complaints, Employers are expected to maintain internal, gender-neutral grievance redressal mechanisms and codes of conduct to address harassment, misconduct, or abuse involving any individual, including persons of all genders and persons with disabilities, in accordance with applicable law and best practices.
6. Candidate Obligation & Conduct
6.1 Candidates agree to:
(a) Provide true, accurate, current and complete information in their profile and applications and update such information promptly as required.
(b) Use the Platform only for bona fide job‑search and career‑related purposes and not for any unlawful, misleading, defamatory, obscene or fraudulent activity.
(c) Refrain from uploading malware, attempting to gain unauthorised access to any systems, or interfering with the security or operation of the Platform.
(d) Respect the confidentiality of any non‑public information received from Employers and use such information only for evaluating and pursuing genuine employment opportunities.
6.2 Candidates acknowledge that the Company is not their employer and that any offer of employment, terms of employment, or disputes relating to employment are strictly between the Candidate and the Employer.
6.3 You agree that you are solely responsible for the content of any messages or calls made using the Services. Hiring.ecomyogi.in shall not review, validate, or assume any responsibility for the content transmitted, stored, or created by you through the Services. Without limitation, hiring.ecomyogi.in disclaims all liability related to: (a) claims of spam, telemarketing violations, robocalls, breach of the DNC (Do Not Call) registry, or any regulatory penalties or third-party claims arising out of use of the Services in breach of applicable laws, including telecommunications laws.
7. Non‑Circumvention
For any candidate introduced through the Platform, the Employer agrees not to bypass the Platform to avoid payment of agreed fees during the active engagement and for a period of 12 months from first introduction via the Platform (or such other period set in a commercial agreement).
If the Employer engages such Candidate in violation of this clause, the Employer shall be liable to pay the applicable success fee and/or liquidated damages as specified in the commercial terms or agreement. The parties agree that such liquidated damages are a genuine pre‑estimate of the Company’s losses and administrative costs and do not constitute a penalty to the extent permitted under applicable law
8. Fees, Payments and Taxes
Fees are payable only by Employers, as per pricing displayed on the Platform or agreed in proposals, work orders, or separate service agreements.
The fees charged for the Services shall be set forth for the use of Platform for specific Services (“Fees“). We reserve the right to charge such Fees as we may determine, in our sole discretion from time to time, to provide you with the Services chosen by you.
You further agree and acknowledge that offers provided by us may vary from user to user.
Unless otherwise specified, all fees are non‑refundable except as provided in the Refund & Cancellation Policy or required by law, and are exclusive of applicable taxes, including GST, which the Employer shall bear.
The Company may suspend or restrict services for delayed or non‑payment.
9. DPDP Act and Data Protection
The Company processes digital personal data in line with the Digital Personal Data Protection Act, 2023 (DPDP Act) and applicable rules.
For the purposes of the DPDP Act, the Company generally acts as a Data Fiduciary in respect of personal data collected directly through the Platform for its own specified purposes (such as operating and improving the Platform, facilitating recruitment and complying with law). Employers act as independent Data Fiduciaries in relation to any personal data they download, export or otherwise process for their own recruitment and employment purposes, and are solely responsible for compliance with applicable law in respect of such processing.
Processing of Candidate personal data is ordinarily based on the Candidate’s consent and/or for lawful purposes related to recruitment and associated functions as permitted under applicable law. Withdrawal of consent or failure to provide certain data may affect the Company’s ability to provide some or all of the Services to such Candidate or Employer.
Employers acknowledge that they receive candidate data from the Company as an independent Data Fiduciary and shall issue their own privacy notices or policies to Candidates where required by law. Employers shall not treat the Company as a joint Data Fiduciary for any independent processing carried out by Employers beyond the limited purpose of using the Platform.
The Company will:
9.1 Obtain valid, free, specific, informed, unconditional, and unambiguous consent from candidates (data principals) before processing their personal data for recruitment and allied purposes, except where processing is permitted under applicable law without consent.
9.2 Provide clear, concise, and accessible privacy notices explaining the purposes of processing, categories of personal data collected, data sharing practices, retention periods, and the rights of data principals.
9.3 Implement reasonable technical and organisational measures, including but not limited to access controls, encryption in transit where feasible, and audit trails, to protect personal data against unauthorised access, disclosure, alteration, or destruction.
9.4 Maintain reasonable data retention schedules and delete, anonymise, or de-identify candidate data when the purpose of processing is fulfilled or consent is withdrawn, subject to applicable legal and regulatory requirements.
9.5 The Company collects limited, self-declared information relating to accessibility or accommodation needs solely for the purpose of facilitating inclusive hiring. Where required for lawful verification, eligibility, or employer-specific requirements, the Company or the Employer may request valid government-issued disability identification documents, including a Unique Disability ID (UDID) or other prescribed records, strictly in accordance with applicable law and with the explicit consent of the candidate. The Company does not collect or process detailed medical histories or diagnostic records beyond what is legally required or reasonably necessary for the stated purpose.
Employers agree to:
9.6 Process candidate data obtained from the Platform strictly for bona fide recruitment purposes and in compliance with the Digital Personal Data Protection Act, 2023, applicable rules, and the Company’s Privacy Policy and related policies.
9.7 Honour candidate requests for access, correction, updating, withdrawal of consent, and deletion, to the extent such requests relate to personal data held or controlled by the Employer.
9.8 Promptly notify the Company of any actual or suspected personal data breach involving candidate data sourced from the Platform and cooperate in investigation, remediation, and regulatory or user notifications where legally required.
9.9 Data Principals shall have the right to access, correction, updating, withdrawal of consent, and grievance redressal in accordance with the Digital Personal Data Protection Act, 2023.
9.10 In the event of a personal data breach, the Company shall notify affected users and, where required, the Data Protection Board of India within a reasonable period and generally as soon as practicable after becoming aware of such breach, and in any event within such timeframes as may be prescribed under applicable law.
9.11 The Company shall periodically assess whether it qualifies as a Significant Data Fiduciary under applicable law and shall comply with any additional obligations, including the appointment of officers or undertaking audits, if so notified or designated by the Government.
10. Accessibility, Inclusion and PwD‑Friendly Practices
The Platform is designed, on a best‑effort basis, to be accessible and usable by PwD users; however, no warranty of full compliance with any specific accessibility standard (such as WCAG 2.1) is given.
Employers are encouraged and, where legally required, obligated to:
10.1 Maintain and implement an Equal Opportunity Policy, including for Persons with Disabilities (PwD) and transgender persons, and register such policy with appropriate authorities where mandated by applicable law.
10.2 Ensure non-discriminatory recruitment processes, accessible infrastructure, reasonable accommodation, and effective measures to prevent harassment and discrimination in the workplace.
10.3 The Company commits to making reasonable, best-efforts improvements to accessibility over time; however, no representation or warranty of full compliance with any specific accessibility standard is made.
10.4 Employers shall not discriminate against candidates on the basis of disability and shall comply with the Rights of Persons with Disabilities Act, 2016 and the rules made thereunder. Any discriminatory conduct by Employers is outside the control and responsibility of the Company.
10.5 Temporary technical limitations, interruptions, errors, or partial non-availability of accessibility features shall not be construed as a breach of these Terms. Accessibility features on the Platform are provided on a best-effort basis and do not constitute a legally enforceable guarantee of compliance with any specific technical or accessibility standard.
10.6 The Platform may rely on third-party service providers, including cloud infrastructure providers, communication services, accessibility tools, analytics providers, and AI platforms. The Company shall not be responsible or liable for any data loss, service interruption, inaccuracies, delays, or failures caused by such third-party services, whether temporary or permanent.
11. Intellectual Property Rights
All rights in the Platform, including software, design, content, trademarks and logos, are owned by or licensed to the Company.
11.1 You may upload or submit certain information, content, submissions, ideas, suggestions, proposals, plans, or other material, whether with or without our request (collectively, “Content“). You hereby grant us a non-exclusive, worldwide, perpetual, irrevocable, transferable, sublicensable, and royalty-free license to use, display, store, host, communicate, make available, modify, adapt, translate and create derivative works of the Content.
11.2 Employers receive a limited, non‑exclusive, non‑transferable, revocable permission to use the Platform solely for internal recruitment in accordance with these Terms and shall not reverse‑engineer, copy, or create derivative works from the Platform except as permitted by law.
11.3 Hiring.ecomyogi.in may request you to submit suggestions and other feedback, including bug reports, relating to the Services or the Platform, from time to time (“Feedback“). Hiring.ecomyogi.in may freely use, copy, disclose, publish, display, distribute, and exploit the Feedback without any payment of royalty, acknowledgment, prior consent, or any other form of restriction arising out of your intellectual property rights. You hereby waive any rights you may have that arise out of such Feedback and agree to execute such documentation as hiring.ecomyogi.in may request to give effect to hiring.ecomyogi.in rights under this Clause.
11.4 “EcomYogi”, the EcomYogi logo, and all associated brand identifiers, whether registered or under application for registration, are trademarks and proprietary marks of EcomYogi G Works OPC Private Limited. Nothing contained on the Platform shall be construed as granting any license or right to use such trademarks without the prior written consent of the Company.
11.5 Users shall not use, reproduce, imitate, modify, or incorporate the Company’s trademarks, trade names, logos, or brand identifiers in any manner, including but not limited to domain names, social media handles, advertisements, job postings, or communications, without express written authorization from the Company. Any unauthorized use shall constitute infringement and passing off under applicable law.
All rights relating to the Company’s trademarks shall survive termination or suspension of a User’s access to the Platform.
The Company reserves the right to seek injunctive relief, damages, and other remedies available under law for any unauthorized or infringing use of its trademarks.
12. Indemnity
12.1 The Employer shall indemnify, defend, and hold harmless the Company, its directors, officers, employees, and agents from and against all losses, liabilities, claims, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
(a) the Employer’s breach of these Terms or any applicable law, including labour, equality, Rights of Persons with Disabilities, transgender, social security, and data protection laws;
(b) any misrepresentation, false statement, or illegality in any job posting, offer, or communication made by the Employer through the Platform;
(c) the Employer’s misuse, unauthorised disclosure, or unlawful processing of candidate or user data;
(d) any employment-related claim, dispute, demand, or proceeding (including claims relating to wrongful termination, discrimination, harassment, or workplace conduct) brought by a candidate or employee against the Employer, to the extent such claim is not caused by the Company’s direct actions.
12.2 This indemnity is in addition to, and not in substitution for, any other rights or remedies available to the Company under law or equity.
12.3 This indemnity shall apply to the maximum extent permitted by applicable law and shall not be construed to require indemnification for any matter to the extent finally determined by a court or tribunal of competent jurisdiction to have been caused by the Company’s gross negligence or wilful misconduct.
13. Limitation of Liability
13.1 To the maximum extent permitted by applicable law, the aggregate liability of the Company for all claims arising out of or in connection with the Platform or the Services, whether in contract, tort (including negligence), equity, or otherwise, shall be limited to the total fees actually paid by the Employer to the Company for the specific Service giving rise to such claim during the six (6) months immediately preceding the first event giving rise to such claim.
13.2 The limitations and exclusions in this Clause 13 shall apply regardless of the form or cause of action, even if the Company has been advised of the possibility of such damages, save and except where prohibited under applicable law.
13.3 Without prejudice to the foregoing, the Company shall not be liable for:
(a) any indirect, incidental, consequential, special, punitive, or exemplary damages, whether arising in contract, tort, or otherwise;
(b) loss of profit, business, revenue, data, goodwill, or anticipated savings;
(c) any act, omission, negligence, misconduct, or default of candidates, Employers, Employer staff, agents, or representatives, or any hiring decision, employment relationship, or workplace conduct between an Employer and a candidate.
13.4 Nothing in these Terms shall exclude or limit any liability that cannot be excluded or limited under applicable Indian law, including liability for death or personal injury caused by gross negligence or wilful misconduct.
13.5 Nothing in these Terms is intended to exclude or limit any rights or remedies that may be available to a user under the Consumer Protection Act, 2019, to the extent such rights or remedies are non-excludable under applicable law.
13.6 Nothing in these Terms shall affect any statutory rights available to users that cannot be waived under applicable consumer protection laws.
14. Refund & Cancellation
14.1 The Services provided by the Company are effort-based recruitment and facilitation services. The Company may invest substantial time, resources, and effort in sourcing, screening, and facilitating candidates, regardless of whether a hiring outcome is achieved.
14.2 In the event of cancellation by the Employer before the commencement of candidate sourcing, a partial refund may be issued after deduction of applicable administrative and processing charges, as notified in the applicable commercial terms or order details.
14.3 In the event of cancellation by the Employer after candidate sourcing or shortlisting has commenced, no refund shall be payable.
14.4 Refunds may be considered only where no candidate profiles are shared with the Employer within the agreed timeline, provided that the Employer has fulfilled all dependencies, inputs, approvals, and cooperation requirements communicated by the Company.
14.5 No refund shall be payable where non-hiring or failure to close arises due to:
(a) rejection of suitable candidates by the Employer without valid or documented reasons;
(b) delays, inaction, or lack of responsiveness by the Employer;
(c) candidates declining offers, failing to join, or withdrawing during the hiring process; or
(d) candidates resigning or leaving employment after joining.
14.6 Any approved refund, if applicable, shall be processed within ten (10) to thirty (30) working days from approval, through the original payment method or such other mode as may be mutually agreed.
15. Suspension and Termination
15.1 Hiring.ecomyogi.in may suspend or terminate an Employer’s or user’s access to or use of the Services, the Platform, or any portion thereof, immediately and at any point, at its sole discretion, if such Employer or user violates or breaches any obligation, responsibility, or covenant under these Terms.
15.2 Without limiting the generality of Clause 15.1, suspension or termination may occur where:
(a) the Employer breaches these Terms, the Company’s Policies, or any applicable law; or
(b) the Employer’s or user’s use of the Platform poses or is reasonably likely to pose security, legal, regulatory, reputational, or operational risk to the Platform, candidates, the Company, or other users.
15.3 These Terms shall remain in effect unless terminated in accordance with this Clause 15 (the “Term”).
15.4 Upon termination under this Clause 15:
(a) the Services and/or the Platform will “time-out”;
(b) the Employer or user shall not be eligible to avail any features of the Services and/or the Platform; and
(c) these Terms shall terminate, except for those clauses that expressly or by their nature are intended to survive termination or expiry.
15.5 Notwithstanding anything to the contrary contained in these Terms, upon termination of access to or use of the Platform and/or the Services, the Employer or user must immediately cease all use of the Platform and the Services.
15.6 Upon termination, accrued rights, payment obligations, and clauses relating to confidentiality, intellectual property, indemnity, limitation of liability, governing law, and dispute resolution shall survive termination.
15.7 The Company may suspend or restrict access to the Platform or Services without prior notice and without assigning detailed reasons where it reasonably believes such action is necessary to prevent legal, regulatory, security, reputational, or operational risk.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of India.
Any dispute that cannot be resolved amicably within 30 days shall be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 (as amended), by a sole arbitrator appointed mutually or in accordance with law, with the seat and venue at Thane, Maharashtra, India, and proceedings in English.
Subject to the arbitration clause, the courts at Thane, Maharashtra, India shall have exclusive jurisdiction.
We/You agree to keep the arbitration confidential and not disclose to any person, other than those necessary to the proceedings, any information, transcripts, or award unless required by Applicable Law. The decision of the arbitrator shall be final and binding on us/you hereto.
We/You hereto agree that our/your consent for the resolution of the dispute through arbitration shall not preclude or restrain you/us from seeking suitable injunctive relief in appropriate circumstances from courts in Thane.
17. Miscellaneous
17.1 Independent Contractors
The parties act as independent contractors; nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between the Company and the Employer or candidates.
17.2 Entire Agreement
These Terms and the Policies constitute the entire agreement between the Company and the Employer regarding the Platform and supersede all prior or contemporaneous understandings, communications, or agreements relating to the subject matter hereof.
17.3 Severability and No Waiver
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Any failure or delay by the Company in enforcing any right shall not constitute a waiver of such right.
17.4 Amendments and Updates
The Company may update or modify these Terms and the Policies from time to time. Continued use of the Platform or Services after such updates shall constitute acceptance of the revised Terms.
17.5 Force Majeure
The Company shall not be liable for any failure or delay in performance of its obligations under these Terms if such failure or delay arises from events beyond its reasonable control, including acts of God, natural disasters, pandemics, epidemics, government orders, labour disputes, power or internet failures, war, terrorism, or any similar force majeure event.
17.6 No Waiver of Rights
No failure or delay by the Company in exercising any right under these Terms shall operate as a waiver of such right, nor shall any single or partial exercise preclude any further exercise of the same or any other right.
17.7 Assignment
The Company may assign or transfer its rights and obligations under these Terms, including in connection with any merger, acquisition, restructuring, or sale of business. Employers shall not assign or transfer their rights or obligations under these Terms without the prior written consent of the Company.
17.8 Language and Translations
Hiring.ecomyogi.in may provide translated versions of these Terms solely to assist in understanding. The English version of these Terms shall be controlling in all respects, and in the event of any inconsistency, the English version shall prevail.
17.9 Regulatory Changes
You acknowledge and agree that the Company may modify the Services or the Platform to comply with applicable laws. As a result, you may be unable to access or use all or any part of the Services or the Platform. The Company shall not be liable for such inability arising from compliance with applicable law.
17.10 Platform Changes
The Company reserves the right to add, modify, suspend, or discontinue any feature, functionality, pricing model, or aspect of the Platform or Services, whether temporarily or permanently, without liability, subject to applicable law.
17.11 Modifications to Terms and Services
Hiring.ecomyogi.in reserves the right at any time to modify these Terms and to add new or additional terms or conditions governing the use of the Platform or Services. Such modifications shall be communicated to you and, unless expressly rejected (in which case these Terms shall terminate), shall become effective immediately and be incorporated into these Terms. The Company also reserves the right to suspend, withdraw, or restrict the availability of all or any part of the Platform or Services for business or operational reasons.
18. Prohibited Conduct
18.1 You shall not use the Platform in any manner except as expressly permitted in these Terms. Without limiting the generality of the preceding sentence, you may not:
- Infringe, violate, or misappropriate any proprietary rights, including but not limited to copyrights, patents, trademarks, or trade secrets, of any party;
- Except as may be provided hereunder, copy, display, distribute, modify, publish, reproduce, store, transmit, post, translate, create any derivative works from, or licence the Platform;
- Use the Platform to transmit any data or send or upload any material that contains viruses, trojan horses, worms, timebombs, keystroke loggers, spyware, adware, or any other harmful programmes or similar computer code designed to adversely affect the operation of any computer software or hardware;
- Use any robot, spider, other automated device, or manual process to monitor or copy the Platform or Services or any portion thereof;
- Engage in the systematic retrieval of content from the Platform to create or compile, directly or indirectly, a collection, compilation, database, or directory;
- Upload or transmit any information or content that is obscene, pornographic, paedophilic, immoral, invasive of another’s privacy, or is relating to or encouraging money laundering or gambling, an online game that causes user harm, or promoting enmity between different groups on the grounds of religion or caste with the intent to incite violence;
- Act in an abusive or threatening manner or use abusive or threatening language on or through the Platform;
- Upload or transmit information or content that is harmful to children or that impersonates another person, or deceive or mislead any addressee about the origin of a message, or knowingly and intentionally communicates any misinformation or information which is patently false and untrue or misleading in nature or, in respect of any business of the Indian government, is identified as fake or false or misleading by the fact check unit of the Indian government;
- Threaten the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign states, or public order, or cause incitement to the commission of any cognizable offence, or prevent investigation of any offence, or insult another nation in any manner;
- Use the Services in any unlawful manner, for fraudulent or malicious activities, or in any manner inconsistent with these Terms;
- Reverse engineer, decompile, or disassemble the Services or the Platform;
- Take any action that may adversely affect the Services or Platform; or
- Violate Applicable Laws in any manner.
19.IT RULES 2021 – INTERMEDIARY & GRIEVANCE
The Company is an intermediary as defined under the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

Grievances may be submitted by email or post, and the Company shall endeavour to acknowledge and resolve such grievances within the timelines prescribed under applicable law.
As an intermediary, the Company does not initiate the transmission, select the receiver of the transmission, or select or modify the information contained in the transmission made by Users, and shall not be liable for any third‑party information, data or communication hosted on the Platform that is made available by Users, provided that the Company complies with its due‑diligence obligations under applicable law.
The Company does not pre-screen, monitor, verify, or endorse any job postings, profiles, communications, or user-generated content and assumes no obligation to do so, except as required under applicable law.
20.Acceptance of Terms (Electronic Acceptance)
20.1 These Terms shall be deemed accepted when the User clicks on an ‘I Agree’ or similar checkbox, creates an account, submits any form on the Platform, or avails any service offered by the Company, including through electronic, digital, or remote means.
20.2 The Company may, from time to time, update these Terms to reflect changes in legal requirements, business practices or the Services. The ‘Last Updated’ date at the top of this page indicates the latest revision. Your continued access to or use of the Platform after any such update constitutes your deemed acceptance of the revised Terms.
